Terms of Service

These Terms of Service govern your access to and purchase of products from Leiben LLC, a Georgia limited liability company. By purchasing from us or using our website, you agree to these Terms.
If you do not agree, do not use our website or purchase our products.
1. Applicability
These Terms apply only to direct to consumer purchases made through Leiben LLC.
Sales to authorized distributors, dealers, resellers, or commercial partners are governed exclusively by separate written agreements. In the event of a conflict between these Terms and a signed distributor agreement, the distributor agreement controls.
If you purchased through a distributor or dealer, your transaction is with that seller, not Leiben LLC.
2. Orders and Payment
All orders are subject to acceptance and availability. We reserve the right to refuse, cancel, or limit any order at our sole discretion.
By submitting payment, you authorize us to charge your selected payment method.
Please review the availability of the product, and understand the terms associated with products listed for Pre-order. Pre-order product availability are subject to change and may incur significant delays beyond our initial lead time.
Providing inaccurate billing information constitutes breach of these Terms.
3. Shipping and Risk of Loss
Shipping is governed by our Shipping Policy, incorporated by reference.
Risk of loss and title transfer to the customer upon transfer to the carrier.
4. Returns and RMA Requirement
All returns require prior written authorization and a valid Return Merchandise Authorization number issued by Leiben LLC.
Returns sent without an authorized RMA may be refused and returned at sender’s expense.
If you purchased through a distributor or dealer, you must process returns through that dealer of record. Leiben LLC will not accept direct returns for third party purchases without express written authorization.
Failure to follow return procedures voids eligibility for refund.
5. Installation and Use
Products must be installed in accordance with all instructions, plumbing codes, electrical codes, and local regulations.
Improper installation, misuse, unauthorized modification, commercial misuse, neglect, or failure to follow instructions voids warranty coverage and may limit liability.
Professional installation is recommended.
6. Two Year Limited Product Warranty
Leiben LLC warrants to the original end user purchaser that its products will be free from defects in materials and workmanship under normal residential use for a period of two 2 years from the date of delivery.
This Limited Warranty applies only to products:
• Purchased directly from Leiben LLC or an authorized dealer
• Installed properly in accordance with instructions and applicable codes
• Used for normal residential purposes
This warranty does not cover:
• Improper installation
• Damage caused by misuse, abuse, neglect, alteration, or unauthorized repair
• Damage from water pressure issues, electrical faults, or improper plumbing
• Commercial or non residential use unless expressly approved
• Normal wear and tear
• Cosmetic damage not affecting functionality
Remedy
At our sole discretion, Leiben LLC will:
• Repair the product
• Replace the defective component
• Replace the product
• Or refund the original purchase price
This remedy is the exclusive remedy available under this Limited Warranty.
Warranty claims require proof of purchase and may require photographs, inspection, or return of the product.
This Limited Warranty is non transferable.
Except as expressly stated above, all other warranties, express or implied, including merchantability and fitness for a particular purpose, are disclaimed to the maximum extent permitted by law.
Some jurisdictions do not allow limitations on implied warranties, so certain limitations may not apply to you.
7. Limitation of Liability
To the maximum extent permitted by law, Leiben LLC shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to:
• Property damage
• Water damage
• Plumbing damage
• Electrical damage
• Loss of use
• Lost profits
• Mold remediation
• Contractor costs
Total liability for any claim shall not exceed the amount paid for the product giving rise to the claim.
8. Chargebacks and Payment Disputes
By completing a purchase, you agree to follow our Return Policy and RMA procedures before initiating any chargeback or payment dispute.
Initiating a chargeback after receiving a product, without complying with our return procedures, constitutes a breach of these Terms.
In the event of a chargeback:
• We reserve the right to dispute the chargeback with full documentation, including proof of delivery, acceptance of Terms, and communications.
• You may be liable for chargeback fees, administrative costs, collection costs, and reasonable attorneys’ fees.
• Retaining the product while reversing payment may constitute fraud.
We reserve the right to pursue recovery through collections or arbitration.
Accounts associated with abusive chargeback behavior may be permanently restricted.
9. Intellectual Property
All website content, product designs, trademarks, branding, and materials are the property of Leiben LLC and may not be used without written consent.
10. Indemnification
You agree to indemnify and hold harmless Leiben LLC from claims arising from:
• Improper installation
• Code violations
• Misuse or modification
• Breach of these Terms
• Third party resale
11. Mandatory Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY.
Any dispute, claim, or controversy arising out of or relating to these Terms, your purchase, or use of products shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.
Arbitration shall take place in Fulton County, Georgia.
You waive the right to bring or participate in a class action lawsuit or class arbitration.
You waive the right to a jury trial.
The arbitrator shall have exclusive authority to resolve disputes relating to interpretation, enforceability, or scope of this arbitration provision.
Each party shall bear its own attorneys’ fees unless otherwise awarded by the arbitrator.
This arbitration provision survives termination of these Terms.
12. Governing Law
These Terms shall be governed by the laws of the State of Georgia, without regard to conflict of law principles.
13. Force Majeure
Leiben LLC shall not be liable for delays or failure to perform due to events beyond its reasonable control, including natural disasters, labor disputes, supply chain interruptions, carrier disruptions, governmental actions, pandemics, power outages, or other unforeseen events.
14. Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
15. Modifications
We reserve the right to modify these Terms at any time. Continued use constitutes acceptance of revised Terms.
